These Terms of Sale (“Terms”) apply to all purchases made from Malheurs Des Hommes, whether through our website or other authorized channels. By placing an order with us, you agree to be bound by these Terms in addition to our Terms of Service, Shipping Policy, and Refund & Return Policy.

1. Order Acceptance

All orders placed are subject to our acceptance. We reserve the right, in our sole discretion, to reject or cancel any order for any reason, including errors in pricing or availability, suspicion of fraud, or potential resale activity.

Your order is considered accepted only once we have processed and confirmed it by email. Until that point, your order is an offer to purchase, not a binding contract.

2. Custom and Made-to-Order Pieces

Many of our pieces are made to order, custom-designed, or engraved — especially in our high jewelry collections. These orders may take 4–6 weeks or more to produce. By placing a custom order, you acknowledge that the piece is being created uniquely for you and is therefore non-refundable and non-exchangeable.

We are unable to modify or cancel custom orders once production has begun.

3. Pricing and Taxes

All prices are listed in U.S. Dollars (USD) and are exclusive of shipping, handling, taxes, duties, and international customs fees (unless otherwise stated).

We reserve the right to correct pricing errors at any time. If an error affects your confirmed order, we will notify you and give you the option to proceed with the corrected price or cancel.

You are responsible for any applicable local taxes or import duties outside the U.S.

4. Payment and Verification

We accept major credit cards and other secure payment methods offered at checkout. By submitting payment, you confirm that you are authorized to use the selected payment method.

Orders may be subject to fraud checks or identity verification. We reserve the right to cancel any transaction that cannot be verified to our satisfaction.

5. Shipping & Delivery

Shipping details are governed by our Shipping Policy. Estimated delivery times are provided as guidance only and are not guaranteed.

Risk of loss and title pass to you upon transfer to the shipping carrier. If your order is lost or damaged in transit, we will assist in filing a claim with the carrier but are not liable for reimbursement beyond what is recovered through the carrier.

6. Final Sale

All sales are final. Due to the handcrafted and exclusive nature of our jewelry, we do not offer returns, refunds, or exchanges. Please review your order carefully before submitting.

If your item arrives damaged or incorrect, you must notify us within 6 hours of delivery confirmation as detailed in our Refund & Return Policy.

7. Product Descriptions

We do our best to ensure that the product information, images, and descriptions are accurate. However, due to the handcrafted nature of our pieces and variations in lighting and screen settings, the actual appearance may vary slightly.

These natural differences are part of what makes each piece unique and are not considered defects.

8. Limitation of Liability

To the fullest extent permitted by law, Malheurs Des Hommes shall not be liable for any indirect, incidental, special, or consequential damages arising out of or related to your purchase or use of our products, even if we have been advised of the possibility of such damages.

9. Governing Law

These Terms are governed by the laws of the State of Wyoming, without regard to conflict of law principles. Any disputes will be resolved in the courts of that state.
